Samething happened to me. On 11/25/2007 i saw a LUD on my approved I-140 (which was approved in Dec, 2006). And then LUD on 12/06/2007 and 12/07/2007 on I-485 for both self and spouse.
Not sure what it could be?? I filed I-485/EAD/AP in late July, 2007. Have received EAD and have done finger printing. Have not received AP yet. Filing Center in Nebraska. My PD is October, 2005, EB3 ROW.

You should take the advice of an attorney. I would recommend Rajiv Khanna. His website is immigration.com. In case india is the only option, you get lactose free stuff as well.

Hello IV members,
I have been watching IV forum during the last four weeks. I feel it is a great place to post questions and comments to help everybody in our long Immigration journey. I have a situation here.
I have filed my H-1B extension, my wife�s H-4 extension, my I-140 and our I-485 applications recently from my current address. I haven�t got the approvals yet for any of them. I am thinking of taking another project(with the same employer of course) next month and relocating to a new state.
I heard that immigration documents don�t get forwarded by USPS. My worry is about my wife�s H-4 extension approval notice as other communications will go either to my employer or lawyer. I know that we have an online form to update our new address to USCIS.
Did anybody run into problems of mails being sent to the address in the forms even after you filled out this form?
Please let me know what you think about relocation after filing immigration papers.

I am planning to contact my district senator to help expedite my AP application.
If you have used such help before how you approached it. Did you call directly or sent email?
I just donno if I should write an email giving entire details or just be brief.

Is NSC processing EB3s regularly?
TSC is not processing EB2s as well ... are they working on EB1s only?
Is it because the Visa #s are exhausted for the period?

Hello Guys,
We all have only 1 thing going on in our mind where every we go & what ever we do is about GC when it will arive. You see this offer & that offer. What you do ? nothing. Because you dont have EAD or GC
So now is the time we all can get together start our effort. No one knows about the result. Atleast some day some one will hear our voice.
This is my first visit to this web site. I have contributed $100 dollars.
Please give help to achive this target. wether it is $1,5,10,20,100,200 etc.

I have H1b Stamped in Jan (Approved in 2007 valid till 1 Oct 2010). My Petioner is well run lawful consultant company (have filed 100+ H1bs since 2001) and he wants me to come to US. My Petioner has in-house as well Client side Projects.
I am having around 8 years of IT experience and Graduate degree in Computer Science. I have worked in past as full time employee with US' No.1 IT Manufacturer in India & have travelled to US twice on Business Visa, I am currently working with a US Bank's Offshore Technology centre in India.
My question is "Is it safe to travel in First week of March 2010 to USA with my H1b stamped in January 2008. In that case What documents I should be carrying along with I-797 Notice of Approval of I-129 Petition.

it seems that they are already married for 2 yrs....In that case she would get 10 yr GC.... The best scenario is that she should wait till she gets the card and then take whatever action she wishes to take

Just to be clear - where were you born? India or Britain? You can be a British citizen, but if you were not born there, you are counted under the chargeable area of India, not ROW.
There really is no "priveledge" that you will recieve, if you were born in the UK. As Roseball mentions, if you are ROW and can file EB2, your dates would be current when it comes time to apply for I145. If you file EB3, you'll be (currently) stuck in Retrogression at I145 stage.
FWIW - you need to maintain status in the US to retain your greencard.

I plan to probably file under the EB2 category soon- I know EB1 and EB2 can be filed separately, however can a EB2 regular and a EB2 with NIW application both be filed separately as well?

I have a question. I am a July 2nd 485, EAD, AP filer and I did not receive my AP yet. My H1 visa stamping got expired, and I am planning to go to India for 2 months. Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?
Is it possible, please advice.

Hello All,
I got my US green card in EB3-I category through consular processing after an interview in Montreal, Canada in 2004.
My PD is 29 March 2002. My family could not accompany me to the interview and hence they did not get their green cards at that time. I wanted to schedule an interview for them since 2008 and the Montreal Consulate informed me that my PD is not current. This is somewhat strange as I have already got my Green card in 2004. I have tried all options but everyone tells me that I have to wait till my PD becomes current. I am not a US citizen yet. The way EB3-I is going it will be easily another year till my PD becomes current. (The PD date has moved by 1 month in the last 6 months)
I will appreciate if anyone has any suggestions for me.

My sister in India may be getting married to a US citizen..she would like to apply for a tourist visa first so she can come stay in the US and spend some time with him before her marriage.
If she applies for a tourist visa, stays in the US for a month or so and then later they apply together for a fiance/K3 visa, are there going to be problems for the K3 visa application considering that she had just applied for a tourist visa before? Is it better to not apply for the tourist visa in this case? Thanks...

If someone is going to be filing for I-140 on a recently approved EB2 (India) while on H1-B in USA with same employer, is it better to check the first box (Alien will apply for visa at a consulate abroad - meaning consular processing of 485) instead of AOS? My understanding is once I-140 is approved and if 485 dates become current, then if CP has been indicated on I-140, then the consulate abroad will order visa number in the month after and the person should get an interview call, even if the dates retrogress back in the following months?
In that case indicating CP is better than AOS on I-140? If so, can the person continue to work on H-1 while waiting for the interview call at consulate abroad?
Thoughts appreciated. Anyone please?
